A legislative fix – involving a retroactive one year extension of the 2009 estate tax rates into 2010 – is likely. {The 2009 tax rates include an exclusion of $3.5m with a 45% top tax rate.}

A few other tax provisions that expired in 2009 are still in legislative limbo with no solid fix in sight:
